Business Terms of Service

This agreement is between ROOTS SHPK, a limited liability company registered in Albania (NUIS M61803028A, registered seat Rruga Zef Jubani, Nd. 4, H. 1, Ap. 3, 1000 Tiranë, Albania), and the business whose staff use Roots Business. It covers your use of the Roots Business console and the publication of your business profile, events, and activities into the Roots Earth consumer apps.

Roots Business is a tool for vetted local venues (bars, restaurants, clubs, hotels, and cultural venues) to publish events and activities that are shown to travelers inside the Roots Earth travel guide, in the cities Roots Earth covers. The service is currently free of charge and is by application: businesses request an account and each venue is verified and provisioned by ROOTS SHPK before it can publish. There is no open self-service registration and nothing you submit is visible to travelers until your account is approved and you publish it.

• By application and approval. Accounts are created after you submit a request and ROOTS SHPK reviews and approves it, or through an invite from a manager of an already-vetted business. Only give account access to your own staff or co-managers.
• Account responsibility. Login credentials are personal. You are responsible for all activity under your accounts, for keeping credentials confidential, and for revoking access of staff who leave the business.
• Accuracy of your details. You must keep your business profile and contact information accurate and up to date.

• Ownership and rights. You warrant that you own or are licensed to use all text, images, and video you upload, including any music audible in a video.
• Licence to us. You grant ROOTS SHPK a non-exclusive, royalty-free licence to host, transcode, adapt for display, and show your content within the Roots apps and in related promotion of the service.
• Accuracy of events. Event and activity details (dates, times, prices, and any offers) must be accurate, and you must honour any offer you publish.
• Public contact details. Your business phone, WhatsApp, address, and profile are published to travelers by design; that is the purpose of the service.

There is zero tolerance for objectionable content. You must not publish content that is illegal, pornographic or sexually explicit, hateful or discriminatory, violent or threatening, harassing, fraudulent or misleading (including fake events, false prices, or scam offers), infringing on intellectual property rights, or harmful to minors. ROOTS SHPK may remove any content and suspend or terminate any account at its sole discretion, without prior notice, for violations of this policy.

You also agree not to:

• impersonate another business, person, or brand, or publish on behalf of a venue you are not authorised to represent;
• upload malware, attempt to break, overload, or circumvent the security of the app or our servers, or access data that is not yours;
• use the service for spam, or in any way that is unlawful or infringes the rights of others.

Published content may be reported by travelers and is subject to reactive moderation. Content can be automatically hidden after multiple independent reports, and ROOTS SHPK may, at its discretion, hide an individual event or activity, hide your entire business, or deactivate an account. Our team reviews reports within 24 hours. If you believe a removal was made in error, contact hello@rootsearth.com to contest it.

The service is provided free of charge at launch and on an “as is” and “as available” basis. We may add, change, suspend, or discontinue the service or any feature at any time. We do not guarantee that the service will always be available or error free.

The Roots Business console, the Roots Earth apps, the ROOTS name and marks, and the software and design are owned by ROOTS SHPK or its licensors and are protected by law. Nothing in these Terms transfers any of those rights to you. You keep the rights in the content you upload, subject to the licence in Section 4.

To the maximum extent permitted by applicable law, ROOTS SHPK will not be liable for any indirect, incidental, special, or consequential damages, or for loss of data, revenue, or profits, arising out of or in connection with your use of the service. Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for fraud or for death or personal injury caused by negligence.

We process personal data as described in our Business Privacy Policy. You are responsible for having a lawful basis to publish any personal data contained in the content you upload (for example, names or images of individuals in event photos).

You may stop using the service at any time and ask us to close your account. We may suspend or terminate your access for breach of these Terms, in particular for objectionable content under Section 5. On termination, your business profile and content are removed from public display.

These Terms are governed by the laws of the Republic of Albania, where ROOTS SHPK is established. The competent courts of Tiranë have jurisdiction over any dispute, without prejudice to any mandatory consumer-protection rights you may have under the law of your own country.

We may update these Terms from time to time. When we do, we will change the “Last updated” date above and may ask you to accept the new version at your next login. By continuing to use the service after an update takes effect, you accept the revised Terms.
